These terms and conditions (the “Terms”) govern your access to and use of www.drbandtraining.com
 (the “Site”) and your purchase and use of any digital training products, services and subscriptions sold through the Site (together the “Training”).

The Site is owned and operated by Vertical Brands Limited (“we”, “us”, “our”).

By accessing the Site and or purchasing any Training, you confirm that you have read, understood and agree to be bound by these Terms.

These Terms contain a dispute resolution clause that impacts your rights about how to resolve disputes. Please read it carefully.

1. Who the Training is for (medical professional requirement)

1.1 The Training is intended for qualified medical and regulated healthcare professionals and other appropriately licensed practitioners only.

1.2 By creating an account, purchasing Training or accessing Training materials you confirm that:

- you are at least 18 years old

- you are a qualified professional permitted by law to undertake aesthetic procedures in your jurisdiction

- you hold all registrations, licences and permissions required in your country, state or region to practise and to perform the procedures you choose to perform

- you will only use the Training within your professional scope of practice

you hold appropriate professional indemnity insurance and any other insurance required by law or industry standards in your jurisdiction.

1.3 We may require verification of eligibility, including evidence of professional registration, licence details and or proof of identity. We may refuse access, suspend access or terminate your account if we reasonably believe you do not meet eligibility requirements or you provide inaccurate or misleading information.

1.4 If we refuse access or terminate access for failure to meet eligibility requirements, you will not be entitled to a refund (subject to any non-excludable statutory rights).

2. Important clinical and legal disclaimer

2.1 The Training is provided for educational and informational purposes for professionals. It does not constitute medical advice to any individual patient and does not replace:

your professional judgement

in-person supervised training where required

local clinical governance and policies

manufacturer guidance and product labelling

legal and regulatory requirements in your jurisdiction.

2.2 Completion of the Training does not grant you any licence, qualification or legal authority to perform procedures. You are solely responsible for ensuring you are competent, appropriately supervised where required and legally permitted to practise.

2.3 You must at all times act within the laws, regulations, standards and professional guidance applicable in your jurisdiction. Where laws differ between jurisdictions, you agree to follow the stricter rule where required for safety and compliance.

3. Accounts and access

3.1 When you create an account you are responsible for maintaining the confidentiality of your login details and for all activity under your account.

3.2 Training access is for a single user only. You must not share, sell, transfer or sublicense access. We may suspend or terminate access if we detect account sharing or misuse.

3.3 We may update the Site, platform or Training materials from time to time including for clinical, regulatory or product updates.

4. User conduct and community areas

4.1 If we offer community features (including private groups), you agree not to:

post unlawful, misleading, defamatory or infringing content

harass or solicit other users

share patient identifiable information or any confidential information

post clinical content in breach of consent, privacy or professional rules.

4.2 You are responsible for ensuring any images, case discussions or materials you share are compliant with applicable privacy laws and professional duties including patient consent.

5. Purchases, prices and payment

5.1 Prices are displayed on the Site and may change at any time. The price at checkout is the price you pay.

5.2 We accept payment by card and any other methods shown at checkout.

5.3 You authorise us and our payment providers to charge your payment method for the amounts due.

6. Payment plans and missed payments

6.1 If you purchase via an instalment plan, you agree to pay all instalments on the dates shown at checkout and in your confirmation email.

6.2 If a payment fails you agree to provide an alternative valid payment method promptly.

6.3 We may suspend access to Training while instalments are overdue. We may terminate access for persistent non-payment and pursue amounts owed using lawful recovery methods.

6.4 Unless prohibited by law, you may be charged reasonable administration fees for repeated failed payments.

7. Subscriptions

7.1 If you purchase a subscription, it will renew automatically at the billing frequency shown at checkout until you cancel.

7.2 You can cancel a subscription by following the cancellation instructions shown in your account area or by contacting support at the address provided on the Site. Cancellation stops future billing. Access continues until the end of the paid billing period unless stated otherwise at checkout.

7.3 Subscription fees are non-refundable for part-used periods unless required by law.

8. Digital content, refunds and right to cancel

8.1 The Training is digital content and or digital services.

8.2 To the extent permitted by law, purchases are non-refundable once access has been granted or content has been accessed or downloaded.

8.3 Where you have a statutory right to cancel, you may be asked to provide express consent for the Training to be supplied immediately and acknowledgement that your right to cancel may be lost once supply begins.

8.4 Nothing in these Terms limits any rights you may have that cannot be excluded under applicable consumer law. If you are purchasing in a business capacity, consumer cancellation rights may not apply.

9. Intellectual property and licence

9.1 All content on the Site and within the Training including videos, protocols, slides, templates, text, graphics, logos and downloadable files is owned by us or our licensors and is protected by intellectual property laws.

9.2 We grant you a limited, personal, non-transferable, non-exclusive licence to access and use the Training for your own professional education.

9.3 You must not copy, reproduce, record, distribute, publish, modify, create derivative works from, resell or commercially exploit any Training materials without our prior written consent.

9.4 You must not remove copyright notices, watermarks or proprietary markings.

10. No guarantees of outcomes

10.1 We do not guarantee any clinical, business or financial outcome from use of the Training.

10.2 You remain solely responsible for your clinical decisions, patient assessment, consent process, product selection, technique, aftercare and complication management.

11. Limitation of liability

11.1 Nothing in these Terms excludes or limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence or for fraud.

11.2 Subject to clause 11.1, to the maximum extent permitted by law we are not liable for any loss, injury, claim, cost or damage arising from:

your use or misuse of the Training

your performance of any procedure

your failure to comply with laws, regulations or professional standards

any third-party products or services

any indirect or consequential loss including loss of profits, loss of reputation or loss of business.

11.3 Subject to clause 11.1, our total aggregate liability to you for any claim arising out of or in connection with the Training or these Terms will not exceed the total amount you paid to us for the relevant Training giving rise to the claim.

12. Indemnity

You agree to indemnify and hold us harmless from and against all claims, liabilities, losses, damages and expenses arising from your breach of these Terms or your clinical practice, use of the Training or performance of any procedure.

13. Technical availability

13.1 We do not guarantee uninterrupted access to the Site or Training and we are not responsible for issues outside our reasonable control including internet outages, platform downtime or device compatibility.

13.2 You are responsible for ensuring you have suitable devices and internet access.

14. Termination and suspension

14.1 We may suspend or terminate your account and access to the Training if you:

breach these Terms

share access or distribute materials

fail to pay amounts due

do not meet eligibility requirements

misuse the Site or community spaces.

14.2 Termination does not affect any rights or obligations that accrued before termination including payment obligations.

15. Privacy

We process personal information in accordance with our Privacy Policy which forms part of these Terms. The Privacy Policy is available on the Site.

16. Applicable law

These Terms are governed by the laws of England and Wales.

17. Dispute resolution

17.1 If a dispute arises, the parties will first attempt to resolve it through good faith informal discussions.

17.2 If unresolved, either party may propose mediation with a neutral mediator. If mediation does not resolve the dispute, the dispute may be referred to arbitration if the parties agree or may be pursued in the courts as set out below.

17.3 Nothing prevents either party from bringing a claim in the small claims court where applicable or seeking injunctive relief to protect intellectual property or confidential information.

17.4 The courts of England and Wales will have jurisdiction, subject to any mandatory consumer jurisdiction rights that apply.

18. Severability

If any provision of these Terms is found unlawful or unenforceable, it will be severed and the remainder will continue in force.

19. Changes to these Terms

We may update these Terms from time to time. We will post the updated version on the Site and may notify users by email. Continued use of the Site or Training after changes take effect constitutes acceptance of the updated Terms.
